In Reply to Ira Panganiban

Dear Mr. Ira Panganiban,

I read your post about the mandate of CHR, natatawa ako sa yo bilang journalist at naaawa ako sa mga followers na nagshare ng post mo.

Eto ang post mo and you interpret it in a way para maloko mo ang mga kapwa mo DDS.

Sasagutin kita ha punto per punto.

Obviously, pang layman yung understanding niyo ng concept at scope ng human rights at ng mandato ng Commission on Human Rights.

Maaring tama po kayo dun sa “all Filipinos” but all Filipinos who are victims of human rights violations. Ang magic word ay hindi “all Filipinos” but “human rights.”

Pag sinabi mong human rights, it refers to the basic political and civil rights enumerated in Art 3, the article on Bill of Rights. Ano ba ang napapaloob sa Article 3? Eto ang ilang halimbawa.

Ang mga karapatang pantaong nabanggit ay madalas ang pag violate nito ay  ginagawa to ng mga may kapangyarihan like pulis or military et al. (Right to Due Process, Right to equal protection of Law, Protection against unreasonable searches and seizures,etc)

While tama ka po na na hindi expressly stated sa constitution na para lang sa mga abuses or violations committed by govt agents (ex. Pulis, courts) ang term na HR violations, ang intent ng constitutional commission ay malinaw sa kanilang deliberation.

Basic po sa statutory construction na kung hindi clear or express ang ibig sabihin ng isang provision, you can refer to the deliberation of the constitutional commission who drafted the constitution  to know the intent of the framers of the constitution. Ano nga ba ang intensyon ng mambabatas when CHR was created. Remember ginawa ito pagkatapos ng Mendiola massacre?  It was created as a response sa malawakang pambabalahura sa karapatang pantao during Marcos regime.

Kaya nga po independent ang CHR, kasi check and balance sya ng state or estado. Sya ang nagchecheck kung may ginagawang pang aabuso ang estado sa karapatang pantao. Kasi po kung aayon tayo sa interpretasyon mong baliko that it should cater to all kasi nabasa mo ang “all Filipino ” then dapat sana under na lang siya ng executive department gaya ng mga pulis di ba? So ano pa ang silbi ng mga pulis?

Nakakainis lang kasi you interpret the law para umayon sa narrative nyo, ang to justify all the killings. At parang TAMAD ka pang magresearch. Ni hindi mo nabanggit ang Executive Order 8, Section 4, Functions of the Committee, describing what the previous Presidential Committee on Human Rights performed. Eto po yun.

SECTION 4. Functions of the Committee. – The Committee shall have the following functions:

a. Investigate complaints it may receive, cases known to it or to its members, and such cases as the President may, from time to time, assign to it, of unexplained or forced disappearances, extra-judicial killings (salvaging), massacres, torture, hamletting, food blockades and other violations of human rights, past or present, committed by officers or agents of the national government or persons acting in their place or stead or under their orders, express or implied.

b. Report its findings to the President and make them public, suggesting such action or actions by the new government to compensate the victims and punish culprits as it may deem appropriate.

c. Propose procedures and safeguards to ensure that, under the new government, human rights are not violated by officers or agents of the government or by persons acting in their name and stead or under their orders, express or implied.

d. Performs such other functions as may be necessary for the protection of human rights and the advancement of social justice in the country.

CHR, which supersedes the PCHR, clearly address violations of human rights perpetrated by agents of the State, so klaro na hindi kasama mandato ng CHR ang pag imbestiga ng violence committed by your addicts, unless addict ay pulis, military et al.

Pinilit mo syang hindi banggitin, I’m not sure kung tanga ka lang or tamad mag research. Uso sa inyo yan eh na mga DDS. Half truth half lies at fake news. Basahin mo ang Supreme Court case na Simon vs. Commission of Human Rights, eto ang GR no. 100150. Sa kasong yan klaro na pinaliwanag ng Supreme Court ang mandato ng CHR.  Kaya lang medyo mahaba ang kaso sa katulad mong tamad magbasa. I doubt it kung babasahin mo.

May mga syet the puwet ka pang nalalaman, mali naman interpretasyon mo. Parang fake news din. Journalist ka pa namang naturingan, pero you are feeding your followers with garbage.
