Open Letter to Sol. General Calida

Dear Solicitor General Calida,

Saan po kayo humuhugot ng kapal ng mukha para mag file ng quo warranto against a Chief Justice? Alam naman natin na unconstitutional yan.

Sure ka ba sa gusto mong gawin? Baka magboomerang ha. Let us define quo warranto:

Quo warranto proceedings are taken against

(a) a person who usurps a public office, position or franchise;

(b) a public officer who performs an act constituting forfeiture of a public office; or

(c) an association which acts as a corporation within the Philippines without being legally incorporated or without lawful authority to do so (Sec. 1, Rule 66, Rules of Court).

The 1987 Constitution prescribes na impeachment lang ang way para matanggal ang isang Chief Justice; quo warranto is not an option.

Pero sige for the sake of argument sabihin natin puwede nga ang quo warranto, kuya, butata ka pa rin kasi under the rules of court.

“An action for quo warranto in relation to a public office must be filed within one (1) year after the cause of the ouster, or the right of the petitioner to hold such office or position, arose (Sec. 11, Rule 66, Rules of Court).”

Di ba dapat alam niyo yan? Lawyer ka di ba?

Pero matanong kita, are you sure na gusto mong ipursue yan? Baka umiyak kayo ha. Kasi kung yang ecklavu mo ay iaapply kay CJ Sereno, puwede din siguro iapply yan sa presidente mo. Baka nakakalimutan mo na sobrang drama ng poon noong nagfile ng candidacy eh paano kung may magfile din sa kanya? Baka maglupasay ka.

Kung talagang malakas ang kaso niyo, isabak niyo sa impeachment sa Senate para magkaalamanan na.

Daming cheche buriche! Tse! Baku bako ang impeachment case niyo kasi. Gaya ng,  you know…
