Dear Fr Ranhilio Aquino,

Hi po. Lagi ko pong binabasa yung mga opinion niyo dati pa. Tama naman po kayo lahat may karapatan magsalita lawyer man o hindi sa mga isyung hinaharap ng bayan ngayon. Ok lang po ba na sagutin ko po ang iilan sa mga sinabi niyo?

1. Agree as stated in the Constitution. Pero po Quo Warranto in election cases maybe filed in RTC (municipal officials), MTC (Barangay Officials), HRET composing of 3 SC Justices and 6 members of the HRep. At saka nabasa niyo po ba ang Ponencia ni Tijam? Sabi doon SC has “original jurisdiction” ONLY over quo warranto petitions affecting the members of the SC. So SC doesn’t  have “original jurisdiction” over all petitions for quo warranto. So medyo mali po kayo doon.

2. Agree naman ako dito. Pero yung sa Chief Justice ay nasa Constitution natin po yun di ba? Hindi ko po alam kung tinuturo niyo po ito sa San Beda pero sa amin sa Arellano tinuro po ito sa amin ni Atty. Roel Pulido, na pag conflict ang Constitution and statutory or procedural rules, dapat po ang  Constitution ang superior and ang susundin. Di ba po ang Quo warranto, ay procedural rules under Rule 66 of the Rules of Court? So hindi po dapat yun ang paboran as against the letter and intent of Article XI, Section 2 of the Constitution. Constitution po dapat ang masusunod.

Agree naman ako dito. Sa President at Vice President dapat within 10 days. Sa mga other officers dapat within the year di ba po? So let us say na allowed ang procedural rules mag take over sa Constitution, So ilang year na nga po uli nakaupo si CJ Sereno? Yup, 5 years na po.  So hindi pa din applicable, right?

4. Luh, may jurisprudence po. May case kahit hindi po Quo Warranto.

“x x x A public officer who under the Constitution is required to be a Member of the Philippine Bar as a qualification for the office held by him and who may be removed from office only by impeachment, cannot be charged with disbarment during the incumbency of such public officer. Further, such public officer, during his incumbency, cannot be charged criminally before the Sandiganbayan or any other court with any offense which carries with it the penalty of removal from office, or any penalty service of which would amount to removal from office.” – In Re Raul M. Gonzales, A.M. No. 88-4-5433, April 15, 1988, 160 SCRA 771.

Nabasa ko po yan. Nadiscuss sa school. Wag po kayong ano.

5. Constitution provides that the manner by which justices are removed is thru impeachment. While it contains the word “may” and not shall the whole sentences connotes that it is mandatory. Wag po nating gamitin ang “may” para lang mailusot ang pambabalahura ng constitution.

Isahin ko na lang po ang sagot sa 6-8 po ha.

Kasi babalik tayo uli sa qualifications. Una po yung premise niyo po sa tingin ko ay mali po kasi po assumero po kayo na valid ang quo warranto. Hindi po sya valid, 130 deans and professors from different school ay nagsabi na mali nga. Kayo lang po ang naiba.

Ok in interpreting what is provided for in the Constitution, Rules of Court and Jurisprudence –dapat magkaroon ng harmonious meaning di ba?  Dapat Rules and Jurisprudence must always adhere to the dictates of the Constitution.

Re qualifications. Dito kayo nagbabank sa  of argumento niyo eh. So for the purposes of discussion

A) JBC has rules na dapat sundin. The requirement of presenting past SALNs is part of this rule but was WAIVED. There’s a difference between NOT FILING (which is required by law) and DID NOT SUBMIT PAST SALN (which means SALNs were filed but cannot be retrieved). Magkaiba yun.

B) Prescribed. The appointment and the qualifications are all public record. You cannot assert that it was newly discovered.

Yung SALN issue niyo ay nawaive na ng JBC during deliberation sa pagpili. So bakit niyo uli binabalik? Palagay ko kasi mahina ang kaso ng impeachment kaya instead dalhin sa Senado, binaliko ang batas at nagfile ng quo warranto. At ikaw bilang isang nag aral sa batas at dean ng isang prestigious school ay iniinterpret mo ang batas para majustify ang mali.

Hindi ko na po sinagot yung iba niyo pong argument kasi nga sinabi niyo lang naman po doon ang qualifications niyo kahit hindi kayo lawyer. Agree naman po ako na lahat dapat magsalita, lalo na pag  binabalahura na ang Saligang Batas. Kahit estudyante or magtataho ka man, dapat ng magsalita. After all, bayan na natin ang nakataya.

Ang tanong na lang po, anong team po kayo kakampi? Team Balahura or Team Inang Bayan?
